Terms of Service

This website is operated by AROMALORE LIMITED ("AromaLore", "we", "us"), a limited company incorporated in the Hong Kong Special Administrative Region. Throughout the site, the terms "we", "us" and "our" refer to AROMALORE LIMITED. By visiting our site and/or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service.

1. Governing law and jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR. Applicable Hong Kong legislation includes the Sale of Goods Ordinance (Cap. 26), the Trade Descriptions Ordinance (Cap. 362), the Unconscionable Contracts Ordinance (Cap. 458), the Control of Exemption Clauses Ordinance (Cap. 71), the Electronic Transactions Ordinance (Cap. 553) and the Personal Data (Privacy) Ordinance (Cap. 486).

2. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction of residence, or that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose.

3. Products, pricing and accuracy

All prices are shown in US Dollars (USD) and exclude any import duties or taxes unless expressly stated at checkout. Natural gemstone and crystal products vary in colour, pattern and inclusions; slight variation from product photographs is normal and is not a defect. We reserve the right to correct obvious pricing or description errors and to cancel any affected order with a full refund.

4. Nature of our products — important notice

Our jewellery and crystal products are sold as decorative and lifestyle items. Any reference to traditional beliefs, Feng Shui, energy, wellbeing or similar concepts is presented for cultural and entertainment interest only. Our products are not medical devices and make no medical, therapeutic, diagnostic or curative claims. They are not a substitute for professional medical, financial or legal advice. No representation is made that any product will bring wealth, luck, healing or any particular outcome.

5. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation. We reserve the right to refuse or cancel any order, including where we suspect fraud, payment authorisation failure, a pricing error, or where we cannot lawfully ship to your destination. Where we cancel, we refund in full.

6. Payment

Payment is taken at the time of order through our authorised payment providers. You warrant that you are authorised to use the payment method submitted. We do not store full card numbers on our servers; card data is processed by PCI-DSS compliant providers.

7. Shipping, risk and title

Delivery timeframes and costs are set out in our Shipping Policy, which forms part of these Terms. Risk in the goods passes to you on delivery. Title passes on receipt of payment in full.

8. Returns

Our Returns & Refund Policy forms part of these Terms. Nothing in these Terms excludes or limits the implied conditions and warranties as to title, description, quality or fitness for purpose implied by the Sale of Goods Ordinance (Cap. 26) where such exclusion is prohibited by law.

9. Intellectual property

All content on this site, including text, product photography, graphics and logos, is the property of AROMALORE LIMITED or its licensors and is protected by copyright. You may not reproduce or use it commercially without our prior written consent.

10. Prohibited uses

You may not use the site for any unlawful purpose, to transmit malicious code, to infringe our or any third party's intellectual property, to harass or abuse others, to submit false information, or to scrape, spider or otherwise interfere with the security features of the Service.

11. Limitation of liability

To the maximum extent permitted by Hong Kong law, our total liability arising out of or in connection with any order shall not exceed the amount you paid for that order. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

12. Third-party links

Third-party materials or links available through this Service are not warranted or endorsed by us. We are not liable for any harm related to the purchase of goods or services from any third-party site.

13. Personal data

Your submission of personal information is governed by our Privacy Policy, which is issued in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

14. Severability and entire agreement

If any provision of these Terms is found unlawful or unenforceable, that provision shall be severed and shall not affect the validity of the remaining provisions. These Terms constitute the entire agreement between you and us.

15. Changes to these Terms

We may update these Terms at any time by posting a revised version on this page. It is your responsibility to check this page periodically. Continued use of the site after changes are posted constitutes acceptance of those changes.
